Analisis Yuridis Tanggung Jawab Pengemudi dan Perusahaan Aplikasi terhadap Penumpang Ojek Online yang Mengalami Kecelakaan

Abstract

TPerkembangan teknologi digital telah mendorong lahirnya layanan ojek online sebagai bagian dari transformasi transportasi berbasis aplikasi yang menawarkan kemudahan, kecepatan, dan efisiensi bagi masyarakat. Di balik manfaat tersebut, muncul persoalan hukum yang kompleks ketika penumpang mengalami kecelakaan dalam penggunaan layanan, terutama berkaitan dengan pembagian tanggung jawab antara pengemudi sebagai pelaksana langsung dan perusahaan penyedia aplikasi sebagai penyelenggara platform. Penelitian ini bertujuan untuk menganalisis dan mendeskripsikan tanggung jawab bisnis layanan ojek online terhadap penumpang yang mengalami kecelakaan. Secara khusus, penelitian ini mengkaji landasan perlindungan hukum bagi penumpang jasa transportasi, hubungan perjanjian antara pengangkut dan penumpang, hak dan kewajiban pelaku usaha, prinsip-prinsip tanggung jawab dalam hukum pengangkutan, serta implementasi tanggung jawab dalam layanan ojek online. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum yang digunakan terdiri atas bahan hukum primer berupa Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan, serta Kitab Undang-Undang Hukum Perdata, dan bahan hukum sekunder berupa literatur ilmiah, buku teks hukum, artikel jurnal, dan doktrin terkait. Hasil penelitian menunjukkan bahwa penumpang jasa transportasi memiliki landasan perlindungan hukum yang cukup kuat, baik dalam sistem hukum perlindungan konsumen maupun hukum pengangkutan. Dalam setiap proses pengangkutan juga lahir hubungan perjanjian yang melahirkan hak dan kewajiban timbal balik antara penumpang dan pelaku usaha. Hukum pengangkutan mengenal prinsip tanggung jawab berdasarkan kesalahan, tanggung jawab berdasarkan praduga, dan tanggung jawab mutlak, yang masing-masing menentukan pola pembuktian dan pembebanan tanggung jawab secara berbeda. Dalam praktik layanan ojek online, tanggung jawab terhadap penumpang yang mengalami kecelakaan pada dasarnya melibatkan dua pihak, yaitu pengemudi dan perusahaan penyedia aplikasi. Namun, pembatasan tanggung jawab perusahaan melalui status pengemudi sebagai mitra kerja menimbulkan ketidakpastian hukum bagi penumpang. Oleh karena itu, diperlukan penafsiran hukum yang lebih tegas dan perlindungan yang lebih efektif agar penumpang sebagai konsumen memperoleh kepastian, keadilan, dan pemulihan hukum yang layak ketika mengalami kerugian
