Analisis Yuridis Pidana Judi Online sebagai Bentuk Cybercrime Transnasional

Modus Operandi, Tantangan Penegakan Hukum Berdasarkan UU ITE dan KUHP Baru

Abstract

Judi online telah berkembang menjadi ancaman cybercrime transnasional yang masif di Indonesia, dengan modus operandi berbasis server luar negeri, aplikasi enkripsi, dan pemasaran via media sosial. Penelitian ini menganalisis yuridis pidana judi online berdasarkan UU ITE (UU No. 11 Tahun 2008 jo. UU No. 19 Tahun 2016) dan KUHP Baru (UU No. 1 Tahun 2023), khususnya Pasal 27 ayat (2), Pasal 303 KUHP lama, serta Pasal 559-567 KUHP baru yang mengatur tindak pidana perjudian digital. Menggunakan pendekatan normatif-yuridis dengan analisis kualitatif data sekunder (peraturan, putusan pengadilan, dan laporan Polri), studi ini mengungkap tantangan penegakan hukum seperti yurisdiksi lintas batas, anonimitas pelaku via VPN/blockchain, serta minimnya koordinasi dengan platform global seperti Google dan Telegram. Temuan menunjukkan bahwa sanksi pidana existing masih lemah terhadap bandar utama (hanya 4-6 tahun penjara dan denda Rp1 miliar), sementara korban sosial-ekonomi mencapai triliunan rupiah per tahun. Disarankan reformasi legislasi berupa UU Pidana Khusus Cyber Judi, penguatan cyber forensics forensik, dan kerja sama ASEAN+Interpol untuk ekstradisi. Penelitian ini berkontribusi pada pengayaan doktrin pidana cybercrime dan rekomendasi kebijakan pencegahan judi online di era digital
