Perlindungan dan Pemanfaatan Hak Merek dalam Bisnis Waralaba Digital di Era Ekonomi Kreatif

Perkembangan ekonomi kreatif di era digital telah mengubah paradigma bisnis, di mana hak merek menjadi aset strategis dalam menciptakan nilai tambah dan daya saing, terutama pada model bisnis waralaba digital. Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap hak merek serta pemanfaatannya dalam pengembangan bisnis waralaba digital di Indonesia. Metode penelitian yang digunakan adalah pendekatan hukum normatif, dengan menelaah peraturan perundang-undangan, putusan pengadilan, doktrin hukum, serta studi literatur yang relevan. Hasil penelitian menunjukkan bahwa kerangka hukum yang diatur dalam Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis masih belum sepenuhnya mengakomodasi perkembangan praktik waralaba digital, terutama terkait penggunaan merek dalam platform daring, domain, dan lisensi digital. Implikasinya, diperlukan pembaruan regulasi dan pedoman yurisprudensi yang lebih responsif terhadap transformasi ekonomi berbasis teknologi. Penelitian ini menegaskan pentingnya harmonisasi antara perlindungan hak merek dan inovasi ekonomi kreatif untuk mendorong kepastian hukum serta pertumbuhan usaha berkelanjutan di era digital.
