Mengapa ASEAN Perlu Memperkuat Mekanisme Pengawasan Pekerja Migran

Pekerja migran merupakan salah satu aktor penting dalam pembangunan ekonomi kawasan ASEAN melalui kontribusi remitansi dan peran mereka di sektor domestik, manufaktur, maupun agrikultur. Namun, kondisi tersebut tidak terlepas dari berbagai permasalahan, terutama diskriminasi, jam kerja panjang, gaji yang tidak dibayar, penyitaan dokumen, hingga kesulitan mengakses mekanisme hukum. Instrumen hukum yang ada, baik internasional seperti Konvensi ILO maupun regional seperti ASEAN Consensus on the Protection and Promotion of the Rights of Migrant Workers (2017), masih bersifat lemah karena tidak mengikat dan tidak dilengkapi dengan mekanisme pengawasan yang efektif. Penelitian ini menggunakan metode normatif dengan menelaah instrumen hukum internasional dan regional, serta data empiris terkait kontribusi dan kerentanan pekerja migran. Temuan utama menunjukkan adanya kesenjangan antara kontribusi ekonomi pekerja migran dengan perlindungan hukum yang tersedia. Oleh karena itu, ASEAN perlu memperkuat mekanisme pengawasan pekerja migran agar sejalan dengan standar hak asasi manusia internasional, menjamin keadilan sosial, serta mendukung integrasi ekonomi kawasan
