Penarikan diri Filipina dari Statuta Roma menimbulkan perdebatan mengenai keberlanjutan yurisdiksi International Criminal Court (ICC) serta pertanggungjawaban pidana atas dugaan kejahatan terhadap kemanusiaan dalam kebijakan War on Drugs pada masa pemerintahan Rodrigo Duterte. Ribuan kematian yang diduga merupakan pembunuhan di luar proses hukum memunculkan perhatian komunitas internasional dan mendorong ICC melakukan pemeriksaan awal pada tahun 2018. Penelitian ini bertujuan menganalisis keberlanjutan yurisdiksi ICC pasca penarikan diri Filipina dari Statuta Roma serta implikasinya terhadap pertanggungjawaban pidana individual mantan kepala negara. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa penarikan diri Filipina tidak menghapus yurisdiksi ICC terhadap kejahatan yang terjadi selama masa keanggotaan negara tersebut. Berdasarkan Pasal 127 Statuta Roma, ICC tetap memiliki kewenangan ratione temporis, sehingga pertanggungjawaban pidana individual atas dugaan kejahatan terhadap kemanusiaan tetap dapat ditegakkan.
